La titular del Juzgado de Primera Instancia e Instrucción Nº3 de O Porriño (Pontevedra), Aurora Alonso Menéndez, ha declarado nulo el contrato de crédito ‘revolving’ firmado entre Wizink Bank y una consumidora hace 14 años al tener un TAE de 26,82% por ser usuraria.
Y es que, hay que recordar, que la Sala de lo Civil del Tribunal Supremo estableció como criterio en una sentencia emitida el pasado 15 de febrero que un crédito que supere en seis puntos porcentuales el precio normal de este tipo de producto será considerado usura.
En el caso que nos ocupa, explica la magistrada en la sentencia 206/2023 de 29 de noviembre, el 15 de octubre de 2010, que es la fecha en la que se firmó el contrato, el tipo medio se situaba en torno al 19,32% para el mercado de tarjetas de crédito frente a la TAE aplicada del 26,82%.
Por lo que “sí se superaban los seis puntos requeridos por el Tribunal Supremo”. Así las cosas, ha obligado a Wizink Bank a devolver las cantidades que abonó la clienta durante toda la vida del crédito en concepto de comisiones por reclamación de posiciones deudoras vencidas, la comisión por disposiciones en efectivo y la comisión por exceso del límite.
Es decir, el juzgado ha ordenado “la restitución recíproca de cantidades como si nunca hubiese existido dicho contrato. Por lo que el prestatario estará obligado a entregar tan solo la suma recibida, y si hubiera satisfecho parte de aquella y los intereses vencidos, el prestamista devolverá al prestatario lo que, tomando en cuenta el total de lo percibido, exceda del capital prestado”.
