El pasado 28 de abril, la AEAT Delegación Especial de Castilla La Mancha aceptó el plan de pagos presentado en el seno de un expediente de Segunda Oportunidad por una deuda con de 126.000 euros, que primeramente fue reducida al 50% en sede judicial. El plan de pagos presentado consiste en el compromiso de pago mensual de 300 euros durante 5 años.
En el 2003 con pocos recursos y mucha ilusión padre e hijo deciden montar en Toledo una empresa de construcción obra civil, dedicada principalmente a la canalización de gas y electricidad.
La historia, con sus propias palabras ….
“Los comienzos fueron buenos y en poco tiempo teníamos 15 empleados y un parque de maquinaria considerable. Los bancos les atendían bien y no teníamos problemas.
En el 2008, con el plan “E” de Zapatero los Ayuntamientos se volvieron locos a realizar obras y nosotros obtuvimos bastantes y ahí empezaron los problemas.
Los ayuntamientos pagaban tarde y mal, por lo que se tuvo que pedir nueva financiación para el circulante, y ya la crisis financiera se hacía sentir, por lo que los bancos no eran tan receptivos como antes.
La pelota se fue haciendo mas grande, hasta que ya no se pudo mantener y el negocio se tubo que cerrar, pero quedaban los préstamos personales, los avales y sobre todo la deuda con Hacienda.
En resumen, nos quedamos sin nada y con mas de 330.000 euros de deuda, de los cuales 124,000 eran con la Hacienda Pública.”
En el 2018 el deudor puso su caso en manos del equipo de No Mas Endeudamiento y el de julio del 2020, obtuvo el primer resultado, el BEPI (Beneficio Exoneración Pasivos Insatisfechos) por todos los créditos ordinarios (206.000 euros) y el 50% de los créditos con la Hacienda Pública (62.000 euros). Pero quedaba pendiente los 62.000 euros restantes con Hacienda, por los que le tenían embargado el sueldo, la devolución del IRPF e incluso un “bonus” que le dio la empresa.
Junto con la aceptación del plan de pagos, la AEAT ha levantado todos los embargos existentes, por lo que ahora sí el protagonista de nuestra historia puede disfrutar de verdad de una Segunda Oportunidad.
