Estos hermanos constituyeron hace casi dos décadas una sociedad mercantil para promover la investigación biomédica. Para ello incurrieron en importantes inversiones de maquinaria, formalizando varias operaciones de crédito con entidades financieras a las que prestaron su fianza personal.
La denegación de varias subvenciones, entre otras cuestiones, hicieron que la empresa no pudiera hacer frente al pago de los créditos, lo que se tradujo en varios procedimientos judiciales ejecutivos frente a la sociedad y frente a los hermanos en su condición de avalistas.
Ante esta situación, ambos hermanos decidieron acudir al mecanismo establecido en la ley de Segunda Oportunidad, habiendo conseguido una exoneración total de las deudas que ostentaban como avalistas de la sociedad, tras la finalización de unos procedimientos que se han seguido ante los Juzgados de lo Mercantil de Madrid y que han durado seis meses.
Esta exoneración total se ha conseguido al tratarse de unas deudas calificadas como créditos ordinarios, sin que existieran deudas frente a AEAT ni Seguridad Social, tampoco créditos privilegiados garantizados con hipoteca.
Con la consecución del EPI (Exoneración Pasivos Insatisfechos) dictada judicialmente, han quedado extinguidos los créditos y la responsabilidad de ambos hermanos en su condición de avalistas de la sociedad.
Una vez más la Ley de Segunda Oportunidad demuestra ser una magnifica herramienta para los avalistas de buena fe que se ven inmersos en procesos de insolvencia de las entidades a las que han avalado.
