A la hora de plantearnos un AEP (Acuerdo Extrajudicial de Pagos) para muchos deudores la problemática de la vivienda habitual puede suponer un obstáculo importante para el deudor.
Si planteamos un AEP, y no existe acuerdo con los acreedores, tendremos que ir al concurso consecutivo, y esto implica la liquidación del patrimonio del deudor para saldar las deudas que se pueda con lo que se obtenga de esa venta, y aquí aparece el gran problema, muchos deudores de buena fe ya han liquidado todo su patrimonio para pagar las deudas y lo único que le que les queda es la “vivienda habitual” es decir, la vivienda habitual de la familia, y que habitualmente esta hipotecada.
En teoría, todos los bienes del deudor se deberán liquidar para hacer frente a las deudas, pero en la práctica esta liquidación de bienes no siempre afecta a la “vivienda habitual”, pueden existir casos en los que la vivienda habitual no se considere en el plan de liquidación.
La jurisprudencia, encabezada por los jueces de Barcelona, con muy buen criterio lo que nos están diciendo, es que si la vivienda está al día de los pagos hipotecarios, y el valor de mercado es similar a la garantía hipotecaria ¿Qué aporta a los acreedores que se liquide el bien en subasta?
Lo dicho anteriormente ha originado numerosas resoluciones judiciales, siendo la mas ilustrativa el Auto de la Audiencia Provincial de Barcelona que explica los supuestos en los que se deben excluir la vivienda habitual del plan de liquidación:
– El préstamo hipotecario se esta pagando puntualmente” y
– La posible venta de la vivienda no reportaba beneficio alguno al resto de acreedores porque no había una previsión razonable de alcanzar un precio superior al de la hipoteca.
En cualquier caso, a la hora de plantear un AEP a un deudor en estas circunstancias, el profesional que lo dirija tiene que ser muy cauto y estudiar bien todas las consecuencias posibles para que su cliente no pierda la vivienda habitual en el proceso.
